This same doctor thus did not report the presence of the worrisome symptoms to any of the doctors who would care for the newborn after transfer to the nursery. To compound the problem, the pediatrician who made rounds at the nursery likewise failed to take any action even though the baby was in respiratory distress.

Within several hours, the newborn went into respiratory and cardiac arrest and subsequently ended up with cerebral palsy. The law firm that represented the family in this matter reported that they were able to achieve a $5,700,000 settlement for the family.
